1 DEFINIZIONI
Nel presente contratto, ai seguenti termini corrispondono i seguenti significati:
Per “Appartamento” si intendel’area indicata [contornata in verde] sulla planimetria allegata come Allegato 1 e comprende i Locali, le Aree Comuni e può includere altri locali affittati ad altri inquilini.
Per «Regolamento condominiale» si intendeil regolamento condominiale pubblicato dal LOCATORE sul sito web Alloggi per Studenti (https://thestudenthousingcompany.com.au/), come di volta in volta modificato dal LOCATORE (agendo in modo ragionevole).
Per «Area comune» si intendel’area indicata [contornata in blu] sulla planimetria allegata come Allegato 1 (se presente).
Per “Verbale di consegna” si intendeil verbale di consegna fornito dal LOCATORE al LOCATARIO ai sensi della Sezione 35 del Residential Tenancies Act.
Per “Co-locatario” si intendeun locatario di qualsiasi locale all’interno dell’Appartamento diverso dall’Immobile.
Per “Periodo Fisso” si intendeil periodo fisso, se specificato, di cui alla clausola 5 della Parte A del presente contratto.
Per “Immobile” si intendonoi locali elencati nella clausola 2 della Parte A del presente contratto.
"Beni del locatore" indicaqualsiasi oggetto appartenente al LOCATORE presente nei Locali.
"Legge sulle locazioni residenziali" indicala Legge sulle locazioni residenziali del 1997 (Vic).
"Collaboratori del locatario" indicaqualsiasi agente, ospite o invitato del LOCATARIO.
"Riparazioni urgenti" indicale "riparazioni urgenti" come definite nella Legge sulle locazioni residenziali.
2 AUMENTI DEL CANONE DI LOCAZIONE
Il LOCATORE e il LOCATARIO concordano che, ai sensi dell’articolo 44 della Legge sulle locazioni residenziali, il LOCATORE possa, di volta in volta, ma non più di una volta ogni 12 mesi, aumentare il canone di locazione dandone preavviso scritto al LOCATARIO con un preavviso non inferiore a 60 giorni.
3 RIDUZIONE DEL CANONE DI LOCAZIONE
Il LOCATORE e il LOCATARIO concordano che il canone di locazione sia ridotto qualora i Locali;
(a) siano distrutti o diventino totalmente o parzialmente inabitabili, salvo che ciò sia dovuto ad atti, omissioni, inadempienze o negligenza del LOCATARIO o dei suoi Collaboratori, oppure
(b) cessino di essere legalmente utilizzabili come residenza, oppure
(c) siano espropriati o acquisiti coattivamente da un’autorità.
4 PAGAMENTO DELLE TASSE COMUNALI, DELL’IMPOSTA FONDIARIA, DELL’ACQUA E DI ALTRE SPESE
4.1 Obblighi del LOCATORE
Il LOCATORE è tenuto a pagare:
(a) le imposte comunali, le tasse o gli oneri dovuti ai sensi di qualsiasi legge (ad eccezione degli oneri a carico del LOCATARIO ai sensi del presente contratto), e
(b) i costi di installazione e gli oneri relativi all’allacciamento iniziale all’Immobile e alle Aree Comuni dei servizi di fornitura di elettricità, acqua, gas, gas in bombole o gasolio,
(c) tutti gli oneri relativi alla fornitura di elettricità, gas o petrolio all’Immobile e alle Aree comuni, e
(d) tutti gli oneri relativi alla fornitura di gas in bombole all’Immobile e alle Aree comuni, e
(e) tutti gli oneri relativi al servizio di fornitura idrica all’Immobile e alle Aree comuni dotate di contatori separati
5 UTILIZZO DEI LOCALI DA PARTE DEL LOCATARIO
5.1 Uso consentito
Il LOCATARIO non deve:
(a) causare o consentire alcun danno ai Locali o alle Aree comuni;
(b) causare o consentire a qualsiasi persona diversa dal LOCATARIO di risiedere nei Locali o nelle Aree comuni;
(c) utilizzare qualsiasi lavandino, lavabo, WC, scarico o struttura simile presente all’interno o collegata ai Locali o alle Aree comuni per scopi diversi da quelli previsti, né compiere alcuna azione che possa danneggiare o ostruire l’impianto idraulico, di scarico o fognario presente nei Locali o nelle Aree comuni;
(d) causare qualsiasi danno (esclusa la normale usura) alla Proprietà del Locatore; oppure
(e) stendere il bucato su qualsiasi balcone o in qualsiasi altro luogo visibile dall’esterno dei Locali o delle Aree comuni.
5.2 Manutenzione a carico dell’AFFITTUARIO
L’AFFITTUARIO è tenuto a:
(a) mantenere l’Immobile in condizioni ragionevolmente pulite;
(b) riporre tutti i rifiuti domestici nel bidone fornito dall’ente locale e esporlo per la raccolta nel giorno designato, per poi riportarlo al posto assegnato o, se del caso, riporre tutti i rifiuti domestici nello scivolo/locale dei rifiuti;
(c) pagare al LOCATORE eventuali costi associati alla riparazione di eventuali danni agli Immobili, alle Aree Comuni o alla Proprietà del Locatore causati dal LOCATARIO o dai suoi Collaboratori (esclusa la normale usura).
5.3 Manutenzione a cura del LOCATORE
Il LOCATORE si riserva il diritto di accedere ai Locali e alle Aree comuni in conformità con la clausola 8 al fine di:
(a) sostituire le lampadine e le batterie dei rilevatori di fumo presenti nei Locali o nelle Aree comuni;
(b) pulire i filtri dell’impianto di climatizzazione (se presenti); e
(c) mantenere i Locali e le Aree comuni in buone condizioni e in ordine, in linea con lo stato in cui si trovavano alla data in cui il LOCATARIO ha occupato per la prima volta i Locali (esclusi la normale usura e qualsiasi danno causato dal LOCATARIO o dai suoi Collaboratori).
5.4 Restituzione dell’
Allo scadere del presente contratto e prima di riconsegnare i Locali liberi al Locatore, il Locatario è tenuto a:
(a) rimuovere tutti i propri beni dall’Immobile e dalle Aree comuni;
(b) lasciare l’Immobile e le Aree comuni nelle stesse condizioni, fatta eccezione per la normale usura, in cui si trovavano alla data in cui il LOCATARIO ha occupato l’Immobile per la prima volta (come attestato dal Verbale di consegna);
(c) lasciare l’Immobile e le Aree comuni ragionevolmente puliti, tenendo conto delle loro condizioni all’inizio del contratto di locazione;
(d) rimuovere o provvedere alla rimozione di tutti i rifiuti dall’Immobile e dall’Area Comune;
(e) assicurarsi che tutti gli impianti di illuminazione presenti nell’Immobile e nell’Area Comune siano dotati di lampadine funzionanti;
(f) restituire al LOCATORE tutte le chiavi e gli altri dispositivi di apertura o simili forniti al LOCATARIO;
(g) provvedere alla pulizia a vapore professionale di tutti i tappeti presenti nei Locali e nelle Aree comuni e fornire al LOCATORE una copia della ricevuta a prova di tale pulizia; e
(h) se richiesto dal LOCATORE, rimuovere qualsiasi modifica apportata dal LOCATARIO ai Locali o alle Aree comuni e riparare eventuali danni causati dall’installazione o dalla rimozione di tali modifiche.
6OBBLIGHI GENERALI DEL LOCATORE PER I LOCALI RESIDENZIALI
6.1 Condizioni all’inizio del contratto
(a) Il LOCATORE deve garantire che, alla data in cui il LOCATARIO inizia per la prima volta a occupare i Locali:
(i) i Locali siano liberi e in buono stato; e
(ii) tutti gli impianti di illuminazione siano dotati di lampadine funzionanti.
(b) Il LOCATARIO riconosce che, alla data in cui il LOCATARIO inizia per la prima volta a occupare l’Immobile, quest’ultimo si trova in condizioni buone e ordinate, come riportato nel Verbale di Consegna.
6.2 Manutenzione ordinaria
Salvo nella misura in cui il LOCATARIO sia responsabile delle riparazioni ai sensi del presente contratto, il LOCATORE deve mantenere la struttura dell’Immobile in buono stato di manutenzione e in condizioni ragionevolmente idonee e adeguate all’occupazione.
6.3 Riparazioni urgenti
Il LOCATORE si impegna a rimborsare al LOCATARIO, entro 7 giorni dal ricevimento di una comunicazione scritta da parte di quest’ultimo, eventuali costi ragionevoli (non superiori a 2.500 dollari) sostenuti dal LOCATARIO per effettuare riparazioni urgenti all’Immobile o alle aree comuni, a condizione che:
(a) il danno non sia stato causato da una violazione del presente contratto da parte del LOCATARIO, e
(b) il LOCATARIO notifichi o compia un ragionevole tentativo di notificare al LOCATORE il danno, e
(c) il LOCATARIO conceda al LOCATORE una ragionevole opportunità di effettuare le riparazioni, e
(d) il RENDER compia un ragionevole tentativo di far eseguire le riparazioni da un artigiano appropriato indicato nel presente contratto, e
(e) le riparazioni siano eseguite, ove opportuno, da persone autorizzate o debitamente qualificate, e
(f) il NOLEGGIATORE, non appena possibile, fornisca o tenti di fornire al FORNITORE DI NOLEGGIO i dettagli scritti delle riparazioni, compresi i costi e le ricevute di qualsiasi spesa sostenuta dal NOLEGGIATORE.
7 SALE OF PREMISES
(a) The RENTAL PROVIDER agrees:
(i) to give the RENTER written notice that the RENTAL PROVIDER intends to sell the Premises, at least 14 days before the Premises are made available for inspection by potential purchasers, and
(ii) to make all reasonable efforts to agree with the RENTER as to the days and times when the Premises are to be available for inspection by potential purchasers.
(b) The RENTER agrees not to unreasonably refuse to agree to days and times when the Premises are to be available for inspection by potential purchasers.
(c) The RENTAL PROVIDER and RENTER agree:
(i) that the RENTER is not required to agree to the Premises being available for inspection more than twice in a period of a week, and
(ii) that, if the parties fail to agree in relation to inspections, the RENTAL PROVIDEDR may at times nominated by the RENTAL PROVIDER show the Premises to potential purchasers not more than twice in any period of a week and must give the RENTER at least 48 hours notice each time;
(iii) the RENTAL PROVIDER must pay the RENTER either half a day’s rent or $30 (whichever is greater) in compensation for each sales inspection that takes place.
8 RENTAL PROVIDER'S ACCESS TO THE PREMISES
(a) The RENTAL PROVIDER agrees that the RENTAL PROVIDER, the RENTAL PROVIDER's agent or any person authorised in writing by the RENTAL PROVIDER, during the currency of this agreement, may only enter the Premises in the following circumstances:
(i) in an emergency (including entry for the purpose of carrying out urgent repairs);
(ii) if the Victorian Civil and Administrative Tribunal so orders;
(iii) if there is good reason for the RENTAL PROVIDER to believe the Premises are abandoned;
(iv) if there is good reason for serious concern about the health of the RENTER or any other person on the Premises and a reasonable attempt has been made to obtain consent to the entry;
(v) to inspect the Premises, if the RENTER is given at least 7 days'
(vi) written notice;
(vii) to carry out, or assess the need for, necessary repairs, if the RENTER is given at least 2 days' notice each time;
(viii) to carry out, or assess the need for, work relating to statutory health and safety obligations relating to the Premises, if the RENTER is given at least 2 days' notice each time;
(ix) to show the Premises to prospective tenants on a reasonable number of occasions if the RENTER is given reasonable notice on each occasion;
(x) as permitted under any other clause in this agreement;
(xi) to value the property, if the RENTER is given 7 days' notice,
(xii) if the RENTER agrees.
(b) The RENTAL PROVIDER agrees that a person who enters the Premises under clause 8(a)(v), 8(a)(vii), 8(a)(viii), 8(a)(ix) or 8(a)(xi) of this agreement:
(i) must not enter the Premises on a Sunday or a public holiday, unless the RENTER agrees, and
(ii) may enter the Premises only between the hours of 8.00 a.m and 6.00 p.m., unless the RENTER agrees to another time. and
(c) The RENTAL PROVIDER agrees that, except in an emergency (including to carry out urgent repairs), a person other than the RENTAL PROVIDER or the RENTAL PROVIDER's agent must produce to the RENTER the RENTAL PROVIDER's or the RENTAL PROVIDER's agent's written permission to enter the Premises.
(d) The RENTER agrees to give access to the Premises to the RENTAL PROVIDER, the RENTAL PROVIDER's agent or any person, if they are exercising a right to enter the Premises in accordance with this agreement.
9 ALTERATIONS AND ADDITIONS TO THE PREMISES
(a) The RENTER agrees:
(i) not to install any fixture or renovate, alter or add to the Premises or the Common Area without the RENTAL PROVIDER's written permission, and
(ii) not to carry out any works including maintenance works to the Premises or the Common Area without the RENTAL PROVIDER's written permission, and
(iii) not to remove, without the RENTAL PROVIDER's permission, any fixture attached by the RENTER that was paid for by the RENTAL PROVIDER or for which the RENTAL PROVIDER gave the RENTER a benefit equivalent to the cost of the fixture, and
(iv) to notify the RENTAL PROVIDER of any damage caused by removing any fixture attached by the RENTER, and
(v) to repair any damage caused by removing the fixture or compensate the RENTAL PROVIDER for the reasonable cost of repair.
(b) The RENTAL PROVIDER agrees not to unreasonably refuse permission for the installation of a fixture by the RENTER or to a minor alteration, addition or renovation to the Premises by the RENTER but the RENTAL PROVIDER may at its absolute discretion withhold approval to any alteration which affects the Common Area or the structure of the Premises.
10 LOCKS AND SECURITY DEVICES
(a) The RENTAL PROVIDER agrees:
(i) to provide and maintain locks or other security devices necessary to keep the Apartment reasonably secure;
(ii) to give each RENTER under this agreement a copy of the key or opening device or information to open any lock or security device for the Apartment or common property to which the RENTER is entitled to have access;
(iii) not to alter, remove or add any lock or other security device without reasonable excuse (which includes an emergency, an order of the Victorian Civil and Administrative Tribunal, termination of a co-tenancy or an apprehended violence order prohibiting a RENTER or occupant from having access) or unless the RENTER agrees; and
(iv) to give each RENTER under this agreement a copy of any key or other opening device or information to open any lock or security device that the RENTAL PROVIDER changes as soon as possible (and no later than 7 days) after the change.
(b) The RENTER agrees:
(i) not to alter, remove or add any lock or other security device without reasonable excuse (which includes an emergency, an order of the Victorian Civil and Administrative Tribunal, termination of a co-tenancy or an apprehended violence order prohibiting a RENTER or occupant from having access) without the RENTAL PROVIDER’s consent (which cannot be unreasonably withheld); and
(ii) to give the RENTAL PROVIDER a copy of the key or opening device or information to open any lock or security device that the RENTER changes within 7 days of the change.
(c) A copy of a changed key or other opening device need not be given to the other party if the other party agrees not to be given a copy or the Victorian Civil and Administrative Tribunal authorises a copy not to be given or the other party is prohibited from access to the Apartment by an apprehended violence order.
11 CHANGE IN DETAILS OF RENTAL PROVIDER OR RENTAL RPOVIDER'S AGENT
The RENTAL PROVIDEER agrees:
(a) if the name and telephone number or contact details of the RENTAL PROVIDER change, to give the RENTER notice in writing of the change within 14 days;
(b) if the address of the RENTAL PROVIDER changes (and the RENTAL PROVIDER does not have an agent), to give the RENTER notice in writing of the change within 14 days;
(c) if the name, telephone number or business address of the RENTAL PROVIDEDR's agent changes or the RENTAL PROVIDER appoints an agent, to give the RENTER notice in writing of the change or the agent's name, telephone number and business address, as appropriate, within 14 days; and
(d) if the RENTAL PROVIDER or RENTAL PROVIDER's agent is a corporation and the name or business address of the corporation changes, to give the RENTER notice in writing of the change within 14 days.
12 RULES
12.1 Owners corporation rules
The RENTER must comply with any Owners Corporation rules that apply to the Premises or the Common Area.
12.2 Building rules
The RENTER must comply with the Building Rules except to the extent that they are contrary to the express provisions of this agreement.
13 SMOKE ALARMS
(a) The RENTAL PROVIDER agrees to ensure that smoke alarms are installed in the Premises the Common Area at the date the RENTER first occupies the Premises as required by law and tested every 12 months.
(b) The RENTER agrees not to remove or interfere with the operation of a smoke alarm installed on the Premises or the Common Area.
(c) The RENTER agrees to test the operation of all smoke detectors no less than every 4 weeks whilst in occupation of the Premises. Should the RENTER find that a battery operated smoke detector requires replacement batteries, the RENTER must notify the RENTAL PROVIDER’s agent and the RENTAL PROVIDER must immediately replace it.
14 ASSICURAZIONE
14.1. Il LOCATARIO si impegna a non compiere, né con atti né con omissioni, alcuna azione che possa comportare un aumento del premium qualsiasi polizza assicurativa stipulata dal LOCATORE a copertura dei Locali e delle Aree Comuni (o del loro contenuto) o che possa comportare l’invalidità di tale polizza assicurativa.
15 DISPOSIZIONI VARIE
15.1 Il LOCATARIO si impegna a inoltrare tutta la corrispondenza recapitata presso i Locali, ma non indirizzata al LOCATARIO o a un Co-locatario, all’agente del LOCATORE entro 7 (sette) giorni dal ricevimento.
15.2 Il LOCATARIO si impegna a mantenere l’immobile ben ventilato in modo che non compaiano muffa, funghi o altre spore sulle pareti interne o sui soffitti dell’Immobile o delle Aree Comuni. Il LOCATARIO si impegna ad assumersi la responsabilità della rimozione di qualsiasi muffa, fungo o spora che compaia nell’Immobile o nelle Aree Comuni a seguito della limitazione della ventilazione in qualsiasi parte dell’Immobile da parte del LOCATARIO stesso.
15.3 Il LOCATARIO manleva il LOCATORE da qualsiasi perdita, reclamo o responsabilità derivante dall’uso da parte del LOCATARIO dei Locali o delle Aree comuni, salvo nella misura in cui ciò sia dovuto a inadempienza, atto negligente o omissione da parte del LOCATORE.
15.4 Il LOCATARIO non deve verniciare, stuccare, riparare o alterare alcuna parete, porta o soffitto senza l’espressa autorizzazione (scritta) del LOCATORE o di un suo agente.
15.5 Il LOCATARIO accetta che l’interno dei Locali e delle Aree comuni sia un’area non fumatori. È pertanto consentito fumare esclusivamente all’esterno dell’Immobile e delle Aree comuni e il LOCATARIO si impegna a provvedere al corretto smaltimento di tutti i mozziconi di sigaretta presenti nei giardini, nei prati, sui balconi, sulle terrazze e in altre aree esterne dell’Immobile e delle Aree comuni.
16 Co-locatari
Se l’Immobile non costituisce l’intero Appartamento, il LOCATARIO riconosce che:
(a) l’Appartamento è destinato a ospitare e può includere Co-locatari;
(b) l’Immobile potrebbe non essere chiudibile a chiave separatamente;
(c) l’AFFITTUARIO esonera totalmente il LOCATORE da ogni responsabilità per perdite o danni (compresi lesioni o decesso) subiti dall’AFFITTUARIO derivanti da o in relazione all’uso o all’occupazione dell’Immobile e delle Aree comuni, anche in relazione alla condotta di eventuali Co-affittuari, salvo nella misura in cui la perdita o il danno sia dovuto a negligenza del LOCATORE.
17 Aree comuni
17.1 Il LOCATORE concede al LOCATARIO, per la durata del presente contratto, la licenza di utilizzare le Aree comuni a fini residenziali accessori all’uso dei Locali, in comune con eventuali Co-locatari.
17.2 Nella misura in cui sia possibile stabilire, in modo soddisfacente per il LOCATORE (che agisce in modo ragionevole), che un eventuale danno ai Locali o alle Aree comuni sia stato causato da un Co-locatario o sia altrimenti di responsabilità di un Co-locatario, tale Co-locatario sarà tenuto a riparare tale danno.
17.3 Qualora non sia possibile stabilire in modo soddisfacente per il FORNITORE DEL SERVIZIO DI NOLEGGIO (agendo in modo ragionevole) che un eventuale danno all’Immobile o alle Aree comuni sia stato causato da un Co-locatario o sia altrimenti di responsabilità di un Co-locatario, il LOCATARIO riconosce e accetta di essere, insieme ai Co-locatari, responsabile in solido per la riparazione delle Aree comuni o dell’Immobile.
