1. DEFINICIONES
En este acuerdo, los siguientes términos tienen los significados que se indican a continuación:
Por «apartamento» se entiendela zona que aparece [delimitada en verde] en el plano adjunto como Anexo 1 e incluye el local, la Zona común puede incluir otros locales alquilados a otros inquilinos.
Por «Normas del edificio» se entiendelas normas publicadas por el ARRENDADOR en la página web de The Student Housing Company (https://thestudenthousingcompany.com.au/), tal y como las modifique el ARRENDADOR de vez en cuando (actuando de forma razonable).
Zona comúnse refiere a la zona que aparece [marcada con un borde azul] en el plano adjunto como Anexo 1 (si lo hay).
«Informe de estado» se refiereal informe de estado que el PROVEEDOR DEL ALQUILER entrega al ARRENDATARIO de acuerdo con el artículo 35 de la Ley de Arrendamientos Residenciales.
«Coarrendatario» se refiere acualquier inquilino de un local dentro del edificio, que no sea el Local.
«Plazo fijo» se refiereal plazo fijo, si lo hay, especificado en la cláusula 5 de la Parte A de este contrato.
«Local» se refiereal local indicado en la cláusula 2 de la Parte A de este contrato.
«Bienes del arrendador»:cualquier objeto que pertenezca al ARRENDADOR y se encuentre en el Inmueble.
«Ley de Arrendamientos Residenciales»:la Ley de Arrendamientos Residenciales de 1997 (Vic).
«Personas relacionadas con el arrendatario»:cualquier agente, invitado o persona invitada por el ARRENDATARIO.
«Reparaciones urgentes»:las «reparaciones urgentes» tal y como se definen en la Ley de Arrendamientos Residenciales.
2. AUMENTOS DEL ALQUILER
El ARRENDADOR y el ARRENDATARIO acuerdan que, de conformidad con el artículo 44 de la Ley de Arrendamientos Residenciales, el ARRENDADOR podrá, de vez en cuando, pero no más de una vez cada 12 meses, aumentar el alquiler notificándolo por escrito al ARRENDATARIO con una antelación mínima de 60 días.
3. REDUCCIÓN DEL ALQUILER
El ARRENDADOR y el ARRENDATARIO acuerdan que el alquiler se reducirá si el Inmueble:
(a) resulten destruidos o se vuelvan total o parcialmente inhabitables, salvo que sea consecuencia de un acto, omisión, incumplimiento o negligencia del ARRENDATARIO o de sus familiares, o
(b) dejen de poder utilizarse legalmente como vivienda, o
(c) sean expropiados o adquiridos de forma obligatoria por una autoridad.
4 PAGO DE LAS TASAS MUNICIPALES, EL IMPUESTO SOBRE BIENES INMUEBLES, EL AGUA Y OTROS GASTOS
4.1 Obligaciones del ARRENDADOR
El ARRENDADOR debe pagar:
(a) las tasas, impuestos o cargos que se deban pagar en virtud de cualquier ley (excepto los cargos que deba pagar el ARRENDATARIO según este contrato), y
(b) los costes de instalación y los cargos por la conexión inicial a la Vivienda y a la Zona común los servicios de suministro de electricidad, agua, gas, gas envasado o gasóleo,
(c) todos los gastos derivados del suministro de electricidad, gas o gasóleo al Inmueble y a la Zona común, y
(d) todos los gastos derivados del suministro de gas envasado al Inmueble y a la Zona común, y
(e) todos los gastos relacionados con el servicio de suministro de agua al Inmueble y a Zona común, que cuenten con contadores independientes
5 USO DEL INMUEBLE POR PARTE DEL ARRENDATARIO
5.1 Uso permitido
El ARRENDATARIO no debe:
(a) causar ni permitir que se produzcan daños en el Inmueble o en la Zona común;
(b) causar o permitir que ninguna persona que no sea el ARRENDATARIO resida en el Inmueble o en la Zona común;
(c) utilizar ningún fregadero, lavabo, inodoro, desagüe o instalación similar situada en el Inmueble o la Zona común , o conectada a ellos, Zona común cualquier fin distinto de su uso previsto, ni hacer nada que pueda dañar u obstruir el sistema de fontanería, desagüe o alcantarillado del Inmueble o de la Zona común;
(d) causar cualquier daño (excluyendo el desgaste normal por uso) a la propiedad del arrendador; o
(e) tender la ropa en cualquier balcón o de forma que sea visible desde el exterior del inmueble o de la Zona común.
5.2 Mantenimiento a cargo del ARRENDATARIO
El ARRENDATARIO debe:
(a) mantener el Inmueble en condiciones razonablemente limpias;
(b) depositar toda la basura doméstica en el contenedor facilitado por la autoridad local y sacarlo para su recogida el día designado para ello, devolviendo el contenedor a su lugar asignado o, si procede, depositar toda la basura doméstica en el conducto o la sala de basura;
(c) pagar al PROPIETARIO cualquier gasto relacionado con la reparación de cualquier daño en el Inmueble, la Zona común la propiedad del Propietario causado por el INQUILINO o las personas a su cargo (excluyendo el desgaste normal por uso).
5.3 Mantenimiento a cargo del PROVEEDOR DE ALQUILER
El PROVEEDOR DE ALQUILER se reserva el derecho a acceder al Inmueble y a la Zona común acuerdo con la cláusula 8, para:
(a) cambiar las bombillas y las pilas de los detectores de humo del Inmueble o de la Zona común;
(b) limpiar los filtros del aire acondicionado (si los hay); y
(c) mantener el Inmueble y la Zona común buen estado y ordenados, tal y como estaban cuando el ARRENDATARIO se mudó por primera vez al Inmueble (excluyendo el desgaste normal y cualquier daño causado por el ARRENDATARIO o sus familiares).
5.4 Entrega del inmueble
El ARRENDATARIO deberá, al finalizar este contrato y antes de entregar el inmueble desocupado al ARRENDADOR:
(a) retirar todos sus bienes del inmueble y de la Zona común;
(b) dejar el Inmueble y la Zona común el mismo estado en que se encontraban en la fecha en que el ARRENDATARIO lo ocupó por primera vez (tal y como consta en el Informe de estado), salvo el desgaste normal por uso;
(c) dejar el Inmueble y la Zona común limpios, teniendo en cuenta su estado al inicio del arrendamiento;
(d) retirar o encargarte de que se retiren todos los residuos del Inmueble y de la Zona común;
(e) asegurarte de que todas las lámparas del Inmueble y de la Zona común bombillas que funcionen;
(f) devolver al ARRENDADOR todas las llaves y demás dispositivos de apertura o similares que te haya proporcionado;
(g) encargarte de Zona común todas las alfombras del Inmueble y de Zona común limpien profesionalmente con vapor y entregar al ARRENDADOR una copia del recibo como prueba de dicha limpieza; y
(h) si así lo exige el ARRENDADOR, eliminar cualquier modificación Zona común por el ARRENDATARIO en el Inmueble o en la Zona común y reparar cualquier daño causado por la instalación o la eliminación de dichas modificaciones.
6OBLIGACIONES GENERALES DEL ARRENDADOR PARA LOCALES RESIDENCIALES
6.1 Estado al inicio
(a) El ARRENDADOR debe asegurarse de que, en la fecha en que el ARRENDATARIO comience a ocupar el Inmueble por primera vez:
(i) el Inmueble esté desocupado y en buen estado; y
(ii) todas las lámparas tengan bombillas que funcionen.
(b) Reconoces que, en la fecha en que empieces a ocupar el Inmueble, este se encuentra en buen estado y ordenado, tal y como se refleja en el Informe de estado.
6.2 Mantenimiento continuo
Salvo en la medida en que te corresponda a ti la responsabilidad de las reparaciones según este contrato, el ARRENDADOR debe mantener la estructura del Inmueble en buen estado y en condiciones razonablemente adecuadas para su ocupación.
6.3 Reparaciones urgentes
El ARRENDADOR se compromete a pagarte, en un plazo de 7 días tras recibir una notificación por escrito de tu parte, cualquier gasto razonable (que no supere los 2.500 $) en el que hayas incurrido para realizar reparaciones urgentes en el Inmueble o en la Zona común cuando:
(a) el daño no se haya producido como consecuencia de un incumplimiento de este contrato por parte del ARRENDATARIO, y
(b) el ARRENDATARIO notifique o intente razonablemente notificar al PROVEEDOR DEL ALQUILER el daño, y
(c) el ARRENDATARIO dé al PROVEEDOR DEL ALQUILER una oportunidad razonable para realizar las reparaciones, y
(d) el PRESTADOR haga un esfuerzo razonable para que cualquier profesional adecuado mencionado en este contrato realice las reparaciones, y
(e) las reparaciones las lleven a cabo, cuando sea necesario, personas con licencia o debidamente cualificadas, y
(f) el ARRENDATARIO, tan pronto como sea posible, facilite o intente facilitar al PROVEEDOR DE ALQUILER los detalles por escrito de las reparaciones, incluyendo el coste y los recibos de todo lo que el ARRENDATARIO haya pagado.
7 SALE OF PREMISES
(a) The RENTAL PROVIDER agrees:
(i) to give the RENTER written notice that the RENTAL PROVIDER intends to sell the Premises, at least 14 days before the Premises are made available for inspection by potential purchasers, and
(ii) to make all reasonable efforts to agree with the RENTER as to the days and times when the Premises are to be available for inspection by potential purchasers.
(b) The RENTER agrees not to unreasonably refuse to agree to days and times when the Premises are to be available for inspection by potential purchasers.
(c) The RENTAL PROVIDER and RENTER agree:
(i) that the RENTER is not required to agree to the Premises being available for inspection more than twice in a period of a week, and
(ii) that, if the parties fail to agree in relation to inspections, the RENTAL PROVIDEDR may at times nominated by the RENTAL PROVIDER show the Premises to potential purchasers not more than twice in any period of a week and must give the RENTER at least 48 hours notice each time;
(iii) the RENTAL PROVIDER must pay the RENTER either half a day’s rent or $30 (whichever is greater) in compensation for each sales inspection that takes place.
8 RENTAL PROVIDER'S ACCESS TO THE PREMISES
(a) The RENTAL PROVIDER agrees that the RENTAL PROVIDER, the RENTAL PROVIDER's agent or any person authorised in writing by the RENTAL PROVIDER, during the currency of this agreement, may only enter the Premises in the following circumstances:
(i) in an emergency (including entry for the purpose of carrying out urgent repairs);
(ii) if the Victorian Civil and Administrative Tribunal so orders;
(iii) if there is good reason for the RENTAL PROVIDER to believe the Premises are abandoned;
(iv) if there is good reason for serious concern about the health of the RENTER or any other person on the Premises and a reasonable attempt has been made to obtain consent to the entry;
(v) to inspect the Premises, if the RENTER is given at least 7 days'
(vi) written notice;
(vii) to carry out, or assess the need for, necessary repairs, if the RENTER is given at least 2 days' notice each time;
(viii) to carry out, or assess the need for, work relating to statutory health and safety obligations relating to the Premises, if the RENTER is given at least 2 days' notice each time;
(ix) to show the Premises to prospective tenants on a reasonable number of occasions if the RENTER is given reasonable notice on each occasion;
(x) as permitted under any other clause in this agreement;
(xi) to value the property, if the RENTER is given 7 days' notice,
(xii) if the RENTER agrees.
(b) The RENTAL PROVIDER agrees that a person who enters the Premises under clause 8(a)(v), 8(a)(vii), 8(a)(viii), 8(a)(ix) or 8(a)(xi) of this agreement:
(i) must not enter the Premises on a Sunday or a public holiday, unless the RENTER agrees, and
(ii) may enter the Premises only between the hours of 8.00 a.m and 6.00 p.m., unless the RENTER agrees to another time. and
(c) The RENTAL PROVIDER agrees that, except in an emergency (including to carry out urgent repairs), a person other than the RENTAL PROVIDER or the RENTAL PROVIDER's agent must produce to the RENTER the RENTAL PROVIDER's or the RENTAL PROVIDER's agent's written permission to enter the Premises.
(d) The RENTER agrees to give access to the Premises to the RENTAL PROVIDER, the RENTAL PROVIDER's agent or any person, if they are exercising a right to enter the Premises in accordance with this agreement.
9 ALTERATIONS AND ADDITIONS TO THE PREMISES
(a) The RENTER agrees:
(i) not to install any fixture or renovate, alter or add to the Premises or the Common Area without the RENTAL PROVIDER's written permission, and
(ii) not to carry out any works including maintenance works to the Premises or the Common Area without the RENTAL PROVIDER's written permission, and
(iii) not to remove, without the RENTAL PROVIDER's permission, any fixture attached by the RENTER that was paid for by the RENTAL PROVIDER or for which the RENTAL PROVIDER gave the RENTER a benefit equivalent to the cost of the fixture, and
(iv) to notify the RENTAL PROVIDER of any damage caused by removing any fixture attached by the RENTER, and
(v) to repair any damage caused by removing the fixture or compensate the RENTAL PROVIDER for the reasonable cost of repair.
(b) The RENTAL PROVIDER agrees not to unreasonably refuse permission for the installation of a fixture by the RENTER or to a minor alteration, addition or renovation to the Premises by the RENTER but the RENTAL PROVIDER may at its absolute discretion withhold approval to any alteration which affects the Common Area or the structure of the Premises.
10 LOCKS AND SECURITY DEVICES
(a) The RENTAL PROVIDER agrees:
(i) to provide and maintain locks or other security devices necessary to keep the Apartment reasonably secure;
(ii) to give each RENTER under this agreement a copy of the key or opening device or information to open any lock or security device for the Apartment or common property to which the RENTER is entitled to have access;
(iii) not to alter, remove or add any lock or other security device without reasonable excuse (which includes an emergency, an order of the Victorian Civil and Administrative Tribunal, termination of a co-tenancy or an apprehended violence order prohibiting a RENTER or occupant from having access) or unless the RENTER agrees; and
(iv) to give each RENTER under this agreement a copy of any key or other opening device or information to open any lock or security device that the RENTAL PROVIDER changes as soon as possible (and no later than 7 days) after the change.
(b) The RENTER agrees:
(i) not to alter, remove or add any lock or other security device without reasonable excuse (which includes an emergency, an order of the Victorian Civil and Administrative Tribunal, termination of a co-tenancy or an apprehended violence order prohibiting a RENTER or occupant from having access) without the RENTAL PROVIDER’s consent (which cannot be unreasonably withheld); and
(ii) to give the RENTAL PROVIDER a copy of the key or opening device or information to open any lock or security device that the RENTER changes within 7 days of the change.
(c) A copy of a changed key or other opening device need not be given to the other party if the other party agrees not to be given a copy or the Victorian Civil and Administrative Tribunal authorises a copy not to be given or the other party is prohibited from access to the Apartment by an apprehended violence order.
11 CHANGE IN DETAILS OF RENTAL PROVIDER OR RENTAL RPOVIDER'S AGENT
The RENTAL PROVIDEER agrees:
(a) if the name and telephone number or contact details of the RENTAL PROVIDER change, to give the RENTER notice in writing of the change within 14 days;
(b) if the address of the RENTAL PROVIDER changes (and the RENTAL PROVIDER does not have an agent), to give the RENTER notice in writing of the change within 14 days;
(c) if the name, telephone number or business address of the RENTAL PROVIDEDR's agent changes or the RENTAL PROVIDER appoints an agent, to give the RENTER notice in writing of the change or the agent's name, telephone number and business address, as appropriate, within 14 days; and
(d) if the RENTAL PROVIDER or RENTAL PROVIDER's agent is a corporation and the name or business address of the corporation changes, to give the RENTER notice in writing of the change within 14 days.
12 RULES
12.1 Owners corporation rules
The RENTER must comply with any Owners Corporation rules that apply to the Premises or the Common Area.
12.2 Building rules
The RENTER must comply with the Building Rules except to the extent that they are contrary to the express provisions of this agreement.
13 SMOKE ALARMS
(a) The RENTAL PROVIDER agrees to ensure that smoke alarms are installed in the Premises the Common Area at the date the RENTER first occupies the Premises as required by law and tested every 12 months.
(b) The RENTER agrees not to remove or interfere with the operation of a smoke alarm installed on the Premises or the Common Area.
(c) The RENTER agrees to test the operation of all smoke detectors no less than every 4 weeks whilst in occupation of the Premises. Should the RENTER find that a battery operated smoke detector requires replacement batteries, the RENTER must notify the RENTAL PROVIDER’s agent and the RENTAL PROVIDER must immediately replace it.
14 SEGURO
14.1. El ARRENDATARIO se compromete a no hacer nada, ya sea por acción u omisión, que pueda provocar un aumento en la premium cualquier seguro que el ARRENDADOR tenga sobre el Inmueble y la Zona común o su contenido), ni que provoque la anulación de dicha póliza de seguro.
15 VARIOS
15.1 El ARRENDATARIO se compromete a reenviar todo el correo que se entregue en el Inmueble, pero que no vaya dirigido a él ni a ningún coarrendatario, al agente del ARRENDADOR en un plazo de 7 (siete) días desde su recepción.
15.2 El ARRENDATARIO se compromete a mantener el inmueble bien ventilado para que no aparezca moho u otras esporas en las paredes interiores o techos del Inmueble o de la Zona común. El ARRENDATARIO se compromete a hacerse cargo de la eliminación de cualquier moho o espora que aparezca en el Inmueble o en la Zona común consecuencia de que el ARRENDATARIO haya restringido la ventilación en cualquier parte del Inmueble.
15.3 El ARRENDATARIO indemnizará al ARRENDADOR por cualquier pérdida, reclamación o responsabilidad que surja del uso que el ARRENDATARIO haga del Inmueble o de la Zona común, salvo en la medida en que se deba a un incumplimiento, acto negligente u omisión por parte del ARRENDADOR.
15.4 No puedes pintar, retocar, reparar ni modificar ninguna pared, puerta o techo sin el permiso expreso (por escrito) del ARRENDADOR o de su representante.
15.5 Aceptas que el interior del Inmueble y la Zona común zonas donde no se puede fumar. Por lo tanto, solo se puede fumar en el exterior del Inmueble y de Zona común el ARRENDATARIO se compromete a encargarse de tirar correctamente todas las colillas de los jardines, céspedes, balcones, terrazas y demás zonas exteriores del Inmueble y de Zona común.
16 Coparrentistas
Si el Inmueble no es la totalidad del Piso, el ARRENDATARIO reconoce que:
(a) el Piso está pensado para acoger a coparrentistas y puede incluirlos;
(b) es posible que el Inmueble no se pueda cerrar con llave por separado;
(c) el ARRENDATARIO exime al ARRENDADOR de toda responsabilidad por pérdidas o daños (incluidas lesiones o fallecimiento) que puedas sufrir y que se deriven o estén relacionados con el uso u ocupación del Inmueble y de la Zona común en relación con la conducta de cualquier coarrendatario, salvo en la medida en que la pérdida o el daño se deba a la negligencia del ARRENDADOR.
17 Zonas comunes
17.1 El ARRENDADOR te concede una licencia, mientras dure este contrato, para que uses las zonas comunes con fines residenciales complementarios al uso del Inmueble, de forma conjunta con cualquier coarrendatario.
17.2 En la medida en que se pueda demostrar, a satisfacción del ARRENDADOR (que actuará de forma razonable), que cualquier daño en el Inmueble o en la Zona común causado por un Coarrendatario o sea de alguna otra forma responsabilidad de un Coarrendatario, dicho Coarrendatario será responsable de reparar dicho daño.
17.3 Si no se puede demostrar, a satisfacción del PROVEEDOR DEL ALQUILER (que actúa de forma razonable), que cualquier daño en el Inmueble o en la Zona común causado un Co-inquilino o sea de alguna otra forma responsabilidad de un Co-inquilino, el INQUILINO reconoce y acepta que será responsable, junto con los Co-inquilinos, de forma solidaria, de la reparación de la Zona común del Inmueble.
